And, as regards the Education Department

post, the position is that the Subhead:- Personal

Emoluments is divided up into sections. The

first section termed "Director of Education"

includes the Administrative and Inspecting staff.

The other sections:- "British staff" and "Non-

British staff" include the staff of the

Government schools of various kinds. Mr.Brawn

is a "Master" provided for under "British Staff",

but he was not being employed as a master or in

a school but as a member of the Administrative

and Inspecting Staff. If it is necessary to

employ one of the "Masters" on such work, he

should be shown in the appropriate section of

the Estimates otherwise they are misleading.

As regards No.2 lodging allowance, I

agree that the payment was not in accordance

with the strict intention of the lodging

allowance scheme. At the same time, so long

as the General Order on the subject is worded

as it is at present, it is difficult to contend

that Mr.Price is not eligible for it. He is

"an officer who with the permission of the

Colonial Secretary does not reside either in

Government quarters or in a tenement in respect

of which a rent allowance is payable under

paragraph 5". As such, he "shall receive a

lodging allowance as follows". In my view the

General Order is badly worded, since it

does not express the intention and does not

leave a discretion to the Government to

refuse to grant the allowance in cases

within the letter of the rule but outside

its spirit. In the case of rent allowance

G.0.109(5) restricts the amount of the

allowance to the difference between 6% of salary

and the rent or assessed annual value of the

tenement occupied; but the paragraph about

rent allowances contains no such restrictions.
